Accused Of Eating Tips and Underpaying
Delivery Staff in SDNY Case

COURTHOUSE, Dec 25 –
Hungry Panda at 130 West 42nd
Street in Manhattan has been
sued for not paying minimum
wage or overtime.
On December 23
U.S. District Court for the
Southern District of New York
Judge Katherine Polk Failla
held a proceeding. Inner City
Press covered it.
Qiang Weng
has been a deliveryman, from
May 2019 to the present. For
Hungry Panda he delivers to
Long Island City and Elmhurst,
Queens.
He was paid $600
a week and $3 a delivery; his
tips were withheld. He sought
certification as a collective
with others.
Judge
Failla said the conditional
certification is denied
without prejudice. A motion to
amend is due on January 25.
The case is Weng
v. HungryPanda US, Inc. et
al., 19-cv-11882 (Failla)
