SDNY COURTHOUSE,

Omar
Arias Casilla
was subject to
a Federal
arrest warrant
in a drug case
on March 25,
2021.
Beyond the
arrest, a
search of the
basement
apartment in
Methuen,
Massachusetts
associated
with him was
conducted,
without a
search
warrant, and
eight kilos of
narcotics were
found.
On
November 16,
2022, U.S.
District Court
for the
Southern
District of
New York Judge
Analisa Torres
held a
in-person
hearing. Inner
City Press
went and
covered it.
The question
is whether the
drugs found
can be used at
sentencing, or
must be
suppressed
under the
Fourth
Amendment.
The
agent
testified that
he thought the
defendant was
a squatter or
trespasser in
the apartment,
and got
consent from
the landlord
for the
search.
But
after that,
the landlord's
boyfriend said
he had told
the defendant
he could stay
in the
basement
apartment.
The
defense lawyer
sought to
admit the
prosecutor's
notes from her
conversation
with the
agent, but had
foundation /
impeachment
problems.
