Sued For Wages Loses Challenge to Subpoena
of Its Landlord in SDNY

Feb 26 – Jesus Trinidad
Martinez sued A Spice Route
Inc. and its Tandoor Palace
for unpaid wages.
Then Tandoor
Palace sought an emergency
hearing on a prior settlement
agreement being made
public.
On January
8, U.S. District Court for the
Southern District of New York
Judge Gregory H. Woods held a
proceeding. Inner City Press
covered it.
The lawyer
for A Spice Route wanted to
submit the prior settlement
under seal. Judge Woods said
that judicial documents are
presumptively public.
He cited a
decision in the case against
Ghislaine Maxwell, arising
after another Judge Woods decision
in the case
against Natalie Mayflower
Sours Edwards.
The lawyer
for A Spice Route asked if
there is a deadline to file.
No, Judge Woods said, if you
file nothing I will in turn do
nothing on this.
But file
they did, and on January 15
Judge Woods held another
conference. This time the
defendants said there is no
jurisdiction, and spoke darkly
again about the alleged breach
of confidentiality of a
previous settlement. The
plaintiffs' lawyer said some
confidentiality is barred by
the FSLA.
On
February 26 a proceeding was
held about Spice Route's
attempt to challenge a
subpoena of its landlord's
records about the lease, rent
payments and communications
about Tandoor Palace.
Judge Woods
denied the request, saying
even if Defendants had
standing, their arguments
concerning relevance and
proportionality are meritless.
