Maldonado sued Butterfield
Catering for failure to pay
overtime.
Butterfield
through counsel says they
don't know who he is, and no
one works more than 20 hours a
week.
On
November 24, 2020 U.S.
District Court for the
Southern District of New York
Judge Lewis J. Liman held a
proceeding. Inner City Press
covered it.
Judge
Liman noted that saying "I
don't know who the plaintiff
is" cannot constitute a basis
for motion to dismiss a
properly pleaded complaint.
But, he said, it
was important the parties talk
and quickly figure out if this
is, as he diplomatically put
it, a misunderstanding.
On August 23,
2021, Judge Liman held a
settlement fairness hearing
was held, with interpretation
into Spanish and discussion of
Form 1099s. Attorneys fees are
capped at one-third but there
were provisions of the
proposed settlement that
correctly troubled Judge
Liman. He asked for
confirmation that these
provisions will be dropped.
The case is
