Maldonado sued Butterfield
Catering for failure to pay
overtime.
Butterfield
through counsel says they
don't know who he is, and no
one works more than 20 hours a
week.
On
November 24 U.S. District
Court for the Southern
District of New York Judge
Lewis J. Liman held a
proceeding. Inner City Press
covered it.
Judge
Liman noted that saying "I
don't know who the plaintiff
is" cannot constitute a basis
for motion to dismiss a
properly pleaded complaint.
But, he said, it
was important the parties talk
and quickly figure out if this
is, as he diplomatically put
it, a misunderstanding.
