On SDNY 2011 Indictment
Gutierrez Miranda Now Plead Not Guilty But Is
Detained

SDNY
COURTHOUSE, Feb 4 –
Gilberto Gutierrez Miranda was
indicted on narcotics charges
in 2011 along with Silvio
Aristy. The latter was
sentenced by U.S. District
Court for the Southern
District of New York Judge
Loretta A. Preska in 2015. But
Gutierrez Miranda was missing
from the docket.
Until
February 4, 2020. That
evening, with Inner City Press
the only media in the SDNY
Magistrates Court, Gutierrez
Miranda was presented and
arraigned. He pled not guilty
through a Federal Defender,
who said he was only filling
in until the defendant
retained (paid for) his own
counsel.
Assistant US
Attorney Elizabeth A. Espinosa
put in a notice of appearance.
At the February 4 proceeding,
she told still new Magistrate
Judge Sarah A. Cave, filling
in for this weeks Mag Court
Judge Sarah Netburn, that she
understood that the defendant
was agreeing to detention
without prejudice to making a
bail application when he
appears with his retained
counsel.
And so it
was: Gutierrez Miranda in a
black t-shirt was led back
into the SDNY Mag Court cell
block, and that Mag Court
closed down for the day. Judge
Sarah Netburn was across Pearl
Street at the monthly session
of the Young Adult Opportunity
Program, for which Gutierrez
Miranda is presumably not
eligible. He is set to appear
before Judge Preska on
February 11.
