SDNY COURTHOUSE,
March 19 -- Miguel Nivar was
arrested in 2019 and charged
with gun possession; he was
released on $25,000 bond with
a curfew.
On
March 19, Assistant US
Attorney Jacob Fiddelman
showed a video he said was of
Nivar with a gun on Townsend
Avenue in the Bronx on March
13 to two judges, with
different results.
He showed
the video to U.S. District
Court for the Southern
District of New York
Magistrate Judge Stewart D.
Aaron on Courtroom 23A, where
Judge Aaron said that Nivar
could remain out of
detention.
Then AUSA
Fiddelman appealed to the
day's Part 1 judge, Chief
Judge Colleen McMahon one
floor above in Courtroom 24A.
Judge McMahon watched three
video. First she said, that is
unmistakenly a gun. Then she
said, that sure looks like the
defendant.
She
ordered Nivar remanded,
telling the two U.S. Marshals
waiting in the back,
"Officers, he's all yours."
Earlier in the afternoon, also
with Inner City Press the only
media in her courtroom, she
had ordered an elderly
defendant released from the
MCC, here. This case is US v.
Nivar, 19-cr-902 (Torres /
McMahon).
