Sentencing in SDNY Veers Into Naloxegol
Derived From Opiate and Chevron Deference

SDNY COURTHOUSE,
Sept 12 – Joseph Galdieri was
charged in 2019 with high
volume marijuana dealing and
gun
charges.
On
September 10 U.S. District
Court for the Southern
District of New York Judge
Jesse M Furman held his
sentencing. Inner City Press
covered it.
There was a
lengthy discussion of how New
York State law treats
naloxegol, an
anti-constipation medication
that is derived from the
opiate thegaine.
Things even
turned to Chevron deference
with regard to the DEA's
application of this term,
"derivative."
There was
push to seal some part of the
sentencing, which Judge Furman
rightly resisted.
Ultimately he
imposed a sentence of 18
months, noting that Galdieri
had a better chance in live
than many defendants before
him.
