Rivera Is Garnished On Bank
of America Debt Without Real Notice So Sues
Under FDCPA

SDNY COURTHOUSE,
Dec 7 – Ray Rivera owed money
to Bank of America. Then the
debt was sold to Cypress
Financial.
On December 7
U.S. District Court for the
Southern District of New
York Judge Lewis J.
Liman held a proceeding. Inner
City Press covered it.
Cypress had
taken the Bank of America debt
and gotten a default judgment
for $11,655.66 in NYC Civil
Court in The Bronx. They sent
notice to a 20 year old
address. Then they garnished
Rivera's wages.
He sued,
under among other statutes the
Fair Debt Collection Practices
Act.
On December 7
Judge Liman said he was
referring the parties to
mediation; he also set a court
date of May 27, 2021.
The case is
Rivera v. Einstein et al.,
20-cv-6294 (Liman)
