Mayorkas Gets 1 Week In SDNY On Denial of
Extension to Imagination America

SDNY COURTHOUSE,
Feb 28 – Alejandro Mayorkas,
the new head of DHS, has been
sued.
On February 26,
U.S. District Court for the
Southern District of New York
Judge Katherine Polk Failla
held a proceeding. Inner City
Press covered it.
Imagination
The Americas Inc. and Marc
Linder of 285 Mott Street
filed suit to challenge the
denial of a Form I-129
petition for extension of
Linder's nonimmigrant L-1A
status.
Linder is
a citizen of the UK. He
was Technical Director for
Imagination America until the
denial.
Judge Failla set
an oral argument on
plaintiffs' order to show
cause for March 1 at 4 pm.
Inner City
Press called in at that time,
and again at 5:45 pm when
Judge Failla ruled. After
addressing a recent decision
by SDNY Judge John G. Koeltl,
Judge Failla said she did not
yet find irreparable harm,
particularly since the US
Attorney's Office said it
would response in one week.
The AUSA noted
repeatedly that the first his
office learned of the dispute
was when the case was filed.
The plaintiff's counsel
replied that administrative
appeal is not required, and
often takes a year. Judge
Failla set another proceeding
for March 15.
