SDNY COURTHOUSE,
August 7 – Mercedes Benz
Financial Services has sued
the City of New York for
seizing cars with perfected
liens on them and not
complying with Ford Motor
Credit Co v. NYPD, 503 F.3d
186 (2d Cir. 2007) and its
notice and opportunity to be
heard requirement.
On August
5, 2022 U.S. District Court
for the Southern District of
New York Judge Vernon S.
Broderick held a proceeding.

On October
10, 2019 NYC seized a 2015
Benz in which MBFS had a
perfected lien. No notice, no
opportunity to be heard - only
the demand that to get the
car, MBFS pay NYC enforcement
fees and Five J's for towing
and storage.
Judge
Broderick said that
depositions are due by October
31, with a post-discovery
conference on November 18.
