Pennsylvania Jail Gets Time Served After
DOJ Commits Not To Violate Him

SDNY COURTHOUSE,
March 27 – Hakeem Baldeo has
been up on three alleged
violations of supervised
release.
On March
26, U.S. District Court for
the Southern District of New
York Judge Jed S. Rakoff held
a change of plea and
sentencing proceeding. Inner
City Press covered both.
Judge
Rakoff appeared to come into
the proceeding with some
incarceratory sentence mind
for the case, which he called
tragic. But advocacy not only
by the defense, but als in
this instance the AUSA,
resulted in time
served.
The defense
praised the programs in the
Cumberland County Prison in
Carlyle, Pennsyvania, and
recounted what he called
possible medical malpractice
in the Westchester Medical
Center in
Valhalla.
The
defense's footnote 2 was that
"The Government represented
that as part of the resolution
of the specifications it will
not move to violate Mr. Baldeo
as a result of the
Pennsylvania charge."
But the
AUSA, at least initially, said
all this meant is that they
did not have any current
intent to violate.
Judge Rakoff said
it would not be possible to go
forward with this unclarity,
that Mr. Baldeo had a right to
know. The AUSA made the
commitment.
And it went
forward, with time served and
best wishes.
