SDNY COURTHOUSE,
Dec 14 – Oumar Legelege,
originally from Burkina Faso,
has sued the restaurants Il
Bastardo and El Coco for
discrimination and
underpayment of his wages as a
delivery man.
Both
were at 191-193 Seventh Avenue
in Manhattan; Mexican Coco is
described as closed, but
Italian Bastardo is still
open.
On September 9
U.S. District Court for the
Southern District of New York
Magistrate Judge Katharine H.
Parker held a proceeding.
Inner City Press covered it.
The case
is still in discovery. One of
the lawyers asked for more
time, explaining that she had
tried to get into Greece but
had been barred from entry.
She had to
hire a babysitter on the
Internet for her toddler; a
Manhattan apartment move was
cited. Extra time was given.
On December 14
Judge Parker held another
proceeding. Now the defendants
were trying to get into
evidence, or at least into a
deposition, the plaintiff's
immigration status. Judge
Parker said she would not
allow this.
One
defense counsel said it was
for credibility, that the
plaintiff had worked under a
false name.
Still no,
Judge Parker ruled. Fact
discovery was extended to
January 29.
