In SDNY Silvestre Mahon Not
Detained Pending Sentencing Citing Rare
Disease

SDNY COURTHOUSE,
Dec 13 – Silvestre Mahon,
charged in a narcotics
conspiracy, got a plea deal
for up to 87 months
imprisonment from the U.S.
Attorney for the Southern
District of New York.
The
question of detention pending
sentencing arose after Mahon
allocuted to the plea on
December 13 before SDNY Judge
Valerie E. Caproni.
Mahon's lawyer Xavier R.
Donaldson urged that he not be
put in detention because he
has a "severe and rare
disease." Donaldson said that
while the docket in the case
is not sealed, these filing
are not there.
In
fact, unlike his
co-defendants, even the letter
setting Mahon's change of plea
does not appear in the public
docket, even five hours after
he pled guilty.
Assistant
US Attorney Adam S. Hobson
said Mahon's family situation
was not a grounds for
non-detention, but that since
he didn't know much about the
disease he would leave it up
to the Court.
Judge Caproni said that since
the disease is rare, it will
take time for the Bureau of
Prisons to prepare. She did
not order detention. Mahon's
sentencing is set for April 3,
2020. The case is US v.
Mahon, 19-cr-212
(Caproni).
