SDNY COURTHOUSE,
July 15 – Workers of New York
Paving Inc. sued it in 2018
for "illegal pay practices."
But now the company is
complaining that the workers
are not providing copies of
their text messages, and may
no longer be part of the case
since they have been laid
off.
On July 15 U.S.
District Court for the
Southern District of New York
Chief Magistrate Judge Gabriel
W. Gorenstein held a discovery
conference. Inner City Press

New York Paving's
lawyer cited the refusal to
response to interrogatories by
sample opt-in plaintiffs
Jonathan Oliver, Shomaria
Patrick, Frankie Distfeno,
German Restrepo, Michasel
Chalmers, John Kouyoumdjian
and Jose Pablo
Laniez.
Judge Gorenstein
asked if plaintiffs' counsel
is still in touch which all
opt-ins, despite them no
longer working for New York
Paving.
The case is Diaz
v. New York Paving Inc.,
