Ricardo Ayala Sought Release
from MCC Due to Coronavirus But Denied As
Danger to Community

SDNY COURTHOUSE,
March 27 --
Ricardo Ayala is set to be
sentenced on May 14. On March
27 his lawyer Kelley J.
Sharkey petitioner for his
release from prison until then
due to the Coronavirus crisis.
U.S.
District Court for the
Southern District of New York
Judge William H. Pauley III
listened to the petition,
including that Ayala's mother
who suffers from dementia
might return to an apartment
to watch over her
son.
Assistant US
Attorney Michael Longyear,
citing among other things the
lack of GPS location
monitoring bracelets, said
that nothing could avoid
danger to the community if
Ayala were released.
Judge Pauley said, I find that
defendant's proposal to be
released to an empty apartment
that is something that
presents a danger to the
community to the community and
to himself. He is a heroin
addict who has not worked in
15 years. He is a career
offender with a criminal
history category of 6. He
faces 151 to 188 months of
imprisonment. So there is also
a serious risk of flight, for
a 53 year old. For those
reasons, Ms. Sharkey, I'm
going to deny your
application.
Sharkey asked for
a copy of the transcript. It
was not clear if she would
seek to appeal. Inner City

Ayala, 19-cr-403
(Pauley).
