SDNY COURTHOUSE,
March 11 – Alpha Industries,
Inc. sued Alpha Clothing Co.
LLC for, what else, trademark
violations. A default was
entered, then contested --but
no notice of appearance was
filed.
On March 11, U.S.
District Court for the
Southern District of New
York Judge Katherine
Polk Failla held a proceeding.
Inner City Press covered it.
The
defendant is seeking to move
the case, but the default
makes that murky.
Also, the
defendant's lawyer did not
file a notice of appearance.
Judge Failla said in her
experience, that is the first
thing that must be done. She
said she will inquiry with the
Clerk of Court.
