Maalik Jones
is up for
re-sentencing
on November 3
for having
joined Al
Shaabab in
Somalia. But
on the morning
of November 1,
the
government's
sentencing
memo had yet
to be put into
the public
docket in the
case. Inner
City Press
wrote it:
"Dear
Judge
Gardephe:
Inner City
Press is
covering the
above
captioned
criminal case
and has
wondered, in
the run-up to
the sentencing
scheduled for
November 3,
2022 why the
Government's
sentencing
submission is
not in the
public
docket.
"I
noticed this
morning's
entry: 'ORDER
as to Maalik
Alim Jones:
Sentencing in
this matter is
scheduled for
November 3,
2022... In its
sentencing
submission,
the Government
refers to
"phone record
exhibits that
support the
factual
conclusion[]
in the PSR"
that the
Defendant made
the call to
Evans' mother.

Br. at 9 n.4)
By 5:00 p.m.
on November 1,
2022, the
Government
will make a
supplemental
submission
containing
these
exhibits.'
"This is a
request not
only that the
5 pm
supplemental
submission be
put on the
public docket
(or a request
to seal that
complies with
applicable
case law) -
but also that
the referenced
"Govt. Sent.
Br." belatedly
be put in the
public
docket."
An hour later,
to their
credit, the US
Attorney's
Office put
their
sentencing
memo into the
docket.
But
to provide the
additional
requested
information,
they has
sought to
delay from 5
pm until noon
on November 2,
the eve of
sentencing.
Inner City
