Trial for
Tapas Bar Sued For Not Paying Overtime Is
Moved Up to June 25 in SDNY

SDNY COURTHOUSE,
May 30 – Lucky 7 Tapas
Bar and La Casa del Mofongo
have been sued for not paying
overtime. The question has
been, when will it go to
trial?
On May 28,
U.S. District Court for the
Southern District of New York
Judge Paul A. Engelmayer held
a proceeding. Inner City
Press covered it.
Judge Engelmayer
chided plaintiffs' counsel for
not filing required pre-trial
submissions, saying You have
to raise your game, this is
Federal court.
The response was
apologetic, and pushing back:
they practice in Federal
court.
A suggestion to
hold the trial in late July,
to avoid what Judge Engelmayer
says will be a flood of trials
in the Fall, was deemed not
possible: a lawyer is going on
vacation for six weeks.
So it was moved
up, to June 25 to 1:45 pm,
then June 28 and 29.
The case is Brito
v. Lucky Seven Restaurant
& Bar LLC et al.,
