Protective Lawsuit in SDNY, Not Stayed

SDNY COURTHOUSE,
Sept 10 – Seafrigo USA has
sued MSC Mediterranean
Shipping Company S.A. over
some French cheese, to
preserve its rights while
another case proceeds in
France.
On April 1, U.S. District
Court for the Southern
District of New York Judge
John G. Koeltl held a
proceeding. Inner City Press
covered it.
The SDNY case
concerns 2744 cartons of
cheese shipped from Le Harve
to New York on the SM TACOMA.
It was
called a "protective suit."
Jump cut
to September 10, when Judge
Koeltl held another
proceedings in the case. Inner
City Press again covered it.
There was still the question
of the relation with the case
in France. Judge Koeltl
declined to stay the SDNY
action, without prejudice to
one or both of the parties
making a motion for that.
