SDNY COURTHOUSE,
Jan 21 – Manuel N. Lazo worked
at the I Trulli Italian
restaurant at 124 East 27th
Street in Manhattan and sued
for underpayment.
On January
21, U.S. District Court for
the Southern District of New
York Judge Lewis J. Liman held
a fairness hearing. Inner City
Press covered it.
Judge Liman
to his credit said he found
the settlement of $14,000
relatively small - especially
when not even paid up front
but over time.
The restaurant's
lawyer explained that the
business was already losing
money to competitor before
COVID, and is now down to a
bit of takeout and two outdoor
tables in the cold.
Judge Liman
also inquired into the
non-disparagement language,
wanting to make sure that Lazo
will be able to say that he
sued, and why, and the
outcome.
The restaurant's
lawyer, who had defended
generally releases, was less
adament about
non-disparagement.
The case is Lazo
v. Valdome Inc. et al.,
20-cv-982 (Liman)
