SDNY COURTHOUSE,
Nov 9 – Charged with
demanding bribes to join the
United Brotherhood of
Carpenters and Joiners of
America, Salvatore Tagliaferro
and John DeFalco face trial in
the U.S. District Court for
the Southern District of New
York - on December 14.
On
September 16, SDNY Judge Paul
A. Crotty held a proceeding.

On November 9,
Judge Crotty held another
conference, and this time
pushed the trial back to
January 18, which he said is
the earliest date to start an
SDNY trial in the new/next
year. The defendant asked for
late February, citing
COVID-19. But on this, the day
of a Pfizer vaccine
announcement, Judge Crotty set
it at January 18. He said, of
course, that if things get
worse with the pandemic, the
defendant can make another
motion.
Tagliaferro's lawyer Michael
Bachrach raised issues about
how a trial can proceed amid
the COVID-19 pandemic. He said
he would oppose masking of
witnesses, and of jurors
during jury selection.
The
Assistant US Attorneys pointed
out that there are trials in
October in SDNY, before Judge
Rakoff and others, after which
"Mr. Bachrach can be shooting
not at a moving target."
Finally,
"The Court set the following
schedule for trial objections
and the commencement of trial:
Objections to trial commencing
on December 14, 2020 are due
by September 30, 2020.
Responses are due by October
14, 2020. Replies are due by
October 21, 2020. A Final
Pretrial Conference is set for
December 7, 2020 at 3 PM.
Trial is scheduled to commence
on December 14, 2020."
