SDNY COURTHOUSE,
May 8 – Andrew Rocco is in the
MCC prison during the
Coronavirus pandemic and he
has only one lung.
On May 1 his
lawyer requested that he be
released pending his
sentencing, noting that Rocco
also has asthma and was only
this week provided with an
albuterol inhaler.
When
Rocco was first remanded he
had no stable residence in New
York City, his lawyer said.
But now he could stay with his
brother on Melrose Avenue in
The Bronx.
While he has been in the MCC,
including on suicide watch at
his request, five inmates in
the MCC have tested positive
for COVID-19 as of April 30.
On Rikers Island, there are
378 positive-tested inmates,
and 38 in the Federal
cooperators' private GEO
prison in Queens which Inner
City Press has covered.
U.S.
District Court for the
Southern District of New York
Judge Andrew L. Carter, who
had denied the applications
for release of a number of
inmates in recent weeks, on
May 8 ordered Rocco released
"unless any pending warrants,
detainers or other issues are
encountered." The case is US
v. Rocco, 18-cr-420 (Carter).
