But Now It's Back with Discovery Fight

SDNY COURTHOUSE,
Oct 5 – Brevet Holdings sued
Paul Iacovacci in New York
State court for unfair
competition and an alleged
violation of the Lanham Act
43(a)(1)(B), False
Advertising. Then the case was
removed to Federal
court.
On February 19,
2021 then U.S. District Court
for the Southern District of
New York Judge William H.
Pauley III held a proceeding.
Inner City Press covered
it.
The Lanham
Act claim had been withdrawn,
and with it, Federal
jurisdiction.
So Judge Pauley,
may he rest in peace, granted
Brevet's motion to remand the
case to NYS court.
That case was
Brevet Holdings, LLC et al v.
Enascor, LLC et al., 21-cv-516
Pauley)
But now, they're
back. On October 5, 2022, SDNY
Magistrate Judge Valerie
Figuerdo held a long discovery
conference with the same
parties. Time had not healed
this wound. Judge Figueredo
told the parties to confer,
and come back if not solved by
October 13.
