SDNY COURTHOUSE,
April 13 – Judge John G.
Koeltl heard from the defense
lawyer for Edward Gonzalez,
currently in FCI Otisville, on
April 13 why he should be
released immediately amid the
#COVID19 pandemic. Inner City
Press covered this hearing in
the U.S. District Court for
the Southern District of New
York.
SDNY
Assistant US Attorney
Chiuchiolo says it's up to the
Bureau of Prisons.
Gonzalez's lawyer says there
are confirmed COVID-19 cases
at Otisville; he is able to
bathe only three times a week
and must interact with someone
to do
that.
Judge Koeltl
said, the Defense letter is
based on the proposition that
the BOP has granted
compassionate release, and the
court can order immediate
release. But that proposition
is not entirely clear to me...
The defense says that he is in
isolation. But there are cases
in this District that there is
no isolation at Otisville, you
may want to look into that...
He ruled:
The current application is
denied without prejudice. The
case is US v. Gonzalez,
18-cr-457 (Koeltl).
