SDNY COURTHOUSE,
March 15 – Silvia Sambula of
the Bronx sued Stop & Shop
in Mount Vernon for slipping
on a wet floor by the ice
cream and hurting "diverse
parts of her body," as the
complaint put it in NYS court.
The case was removed.
On
March 15, U.S. District Court
for the Southern District of
New York Magistrate Judge
Barbara D. Moses held a
proceeding. Inner City Press
covered it.
Judge Moses
asked if the plaintiff wanted
a jury trial. The response was
that choice did not have to be
made so early in the state
courts. The lawyer asked,
"Should I perfect my jury
request?"
Judge Moses urged
that the rules be
consulted. Later she
wrote that "application made
after the expiration of the
deadline in question may be
summarily denied." Discover
