Lambrakis Sold Oxy Now Wants Out of
MDC Amid Covid 19 But SDNY Judge Pauley Has
Questions

SDNY COURTHOUSE,
April 20 – Emmanuel Lambrakis
is in the MDC prison in
Brooklyn awaiting sentencing
after pleading guilty to
having illegal prescribed
oxycodone without a legitimate
media purpose.
Now amid
the Covid-19 pandemic he wants
out of the jail, and US
Attorney's office apparently
supports his bid.
But on
April 20 in a proceeding
covered by Inner City Press,
U.S. District Court for the
Southern District of New York
Judge William A. Pauley had
several questions for
Assistant US Attorneys Ryan B.
Finkel and Sarah
Mortazavi.
Why if they
previously said Lambrakis was
a risk of flight had they
change these position now? Did
Lambrakis and his proposed
surety, his wife, filed tax
returns for 2016, 2017 and
2018? Judge Pauley wants to
see them. And the previous
sureties who traveled to
Greece, had they returned?
One
of Lambrakis' two CJA lawyers
answer that one of the
sureties had returned. Judge
Pauley asked for further
written submissions, noting
that since Lambrakis is under
quarantine he could not be
released until April 28 in any
event.
One
of Lambrakis' lawyer says he
has a trial before Judge
Dearie in the EDNY on July 6.
Judge Pauley said he doubts
there was be jury trial by
July 6, but nevertheless
pushed the non-jury Fatico
hearing back to July 28. The
case is US v. Lambrakis,
17-cr-208 (Pauley).
