Oct 19 – Anthony Rapp's
lawsuit against Kevin Spacey
was removed to Federal court
in November 2020, and an
anonymous co-plaintiff C.D.
was added.
Spacey wanted to
make C.D.'s name public, to
order to conduct discovery, he
says. C.D.'s lawyers

On May 26, 2022
U.S. District Court for the
Southern District of New York
Judge Lewis A. Kaplan held a
hearing, with Spacey
testifying, on Rapp's motion
to remand the case. Judge
Kaplan at the end said it is
his present intention to deny
the motion to remand, and that
the trial will start in

last day of evidence, cross of Spacey's Dr.
Bardey. Rapp's lawyer: So there were
tests that Dr. Rocchio performed, that found
Anthony Rapp was reporting his symptoms
accurately, right?
Dr. Bardey: Correct. Rapp's lawyer: So they
found him to be an honest reporter -- Judge: I
used on this. Don't use the phrase. Rapp's
lawyer: What did Dr Rocchio score Mr. Rapp,
out of 63?
Dr Bardey: I don't remember. Rapp's lawyer:

with you? Dr Bardey: I do not. Rapp's lawyer:
So I show it to you. 19 out of 63. But you

Rapp's lawyer: How much do you charge Mr.
Spacey in this case? Dr Bardey: $500 an
hour. Rapp's lawyer: So you've gotten
$45,000. You're a paid expert, right? Dr.
Bardey: My time is compensated appropriately.
Rapp's lawyer: You spoke to Mr. Rapp's friend

Ken would get upset at Mr. Rapp of staying in
touch with people from his distant past? Did
Ken try to stop it? Spacey's expert
Bardey: Yes. Ken said he felt threatened.

Mr. Rapp was asked if he had experience fear
and shame, right? Dr Bardey: He said yes - and

unfortunately - Mr. Rapp could have turned off
Gallery View and not seen Mr. Spacey in the
depositions and proceedings, right? Spacey's
expert Bardey: Yes.
Spacey's lawyer: If Mr. Rapp, of all
the in person proceedings, only came to
the one with a lot of press where Mr. Spacey
was going to testify, would that be consistent
with PTSD? Spacey's expert Bardey: No. [See here,

know how he felt being deposed in this case?
Spacey's lawyer: Objection, argumentative.
Rapp's lawyer: Let me rephrase. Might it have
been helpful to ask?
Bardey: It wasn't a factor
Rapp's lawyer: Did you ask Mr. Rapp if
he knows how to cut Mr. Spacey's face out of
Zoom? Spacey's expert Bardey: No.
After rounds of re-re-direct and re-re-cross,
"the Defense rests." Judge Kaplan tells jurors
to return tomorrow for closing arguments.
