Feb 6 – Among side the
higher profile cases of US v.
Michael Avenatti and Sarah
Palin v. New York Times, last
week Inner City Press covered
among other proceedings this
status conference with a
criminal defendant under
lock-down in the Metropolitan
Detention Center in Brooklyn:
Defendant: What
the f*ck is this, you gotta
talk about me?
Criminal Justic
Act Lawyer: It's called a
status conference.
Defendant: I got
six stitches in my head.
CJA Lawyer:
That's from when you got
picked up?
Defendant: No, it
happened in here. January 13.
Y'all coulda just done this
sh*t on your own. You don't
need me here.
CJA lawyer:
You have a right to be
informed.
Defendant: How I
got rights when I'm wrong. I
got two kids. Every time they
turn around I'm in f-ing
prison.
Defendant: What's
the charges?
CJA lawyer:
Violation of supervised
release.
Defendant: Oh
yeah? What I did to violate?
Ask the US Attorney, she know?
What the F I did?
CJA lawyer: It's
actually probation that
knows... Use of marijuana,
change of residence.
Defendant: Do you
here how much B.S. you just
said? Didn't talk to a
re-entry specialist? Who the
hell is that? Y'all just keep
making up new charges.
CJA lawyer:
Someone called a re-entry
specialist was going to help
you get a job. Defendant:
Called?
CJA: This
is to get you the help you
need.
Defendant: The
help I need? I need y'all to
leave me the F alone.
Judge: This is
the judge. Who is on the
phone?
Defendant: Who
the F you think is on the
phone?
Judge:
Counsel, it seems you haven't
spoken with the defendant to
explain --
Defendant: I
don't trust him. He is working
with the US Attorney. I'm
gonna talk to all of y'all.
Judge: Have you
gotten the defendant a copy of
the specifications?
CJA lawyer:
We went through the
presentment on January 5,
Magistrate Lehrburger, with
some difficulty
Defendant: Why
you call my family? That's a
violation of attorney - client
privilege, MF-er! Y'all sent
the Marshals to put guns in my
face!
CJA lawyer: I
would like to have this case
wrapped up next week. There
have not been in-person visits
at the MDC. Phone
consultations are not helping.
Defendant: And if
I get out I'm still gonna be
homeless! What the F am I
gonna do?
CJA lawyer:
We could find a program.
Defendant: What
f-ing program?
Judge: Next one
must be in person. As far as
I'm concerned we could have a
trial --
Defendant: That's
what I want! A MF-ing trial!
Judge: These things can be
established by probation.
Feb 1 Judge: I'll
get back to counsel. I'm going
to end this now.
Defendant: I
ain't nobody's slave, MF!
[Loud sound]
Voice: "Hello,
