Fee of LI Charged But Not Yet Arrested After Man Who Punched Capitol Police Jan 6 Is Freed

FEDERAL COURT, Jan 18 – Days after in the US Capitol among other things Mark Leffingwell stuck a Capitol Police officer repeatedly with a closed fist, he was released to fly back to his home in Seattle, no GPS monitor, no bond. 

 For Long Island's Thomas Fee it may be different, though as of 2 pm on January 18 Fee has not yet been arrested:  From the complaint: "Witness-1 stated that, Witness-1 texted Fee and asked him, in sum and substance, if he was in fact in Washington, D.C. Fee responded affirmatively. A short time later, Fee texted Witness1 a “selfie” photograph of Fee from inside the U.S. Capitol Rotunda. Witness-1 initially deleted the photograph after receiving it, but then was able to recover it on witness 1’s phone. Witness-1 provided DSS with the photograph of Fee inside the U.S. Capitol, and DSS forwarded the photograph to JTTF. Witness-1 confirmed to JTTF that the individual closest to the camera at the bottom of the photograph wearing a dark-colored cap and appearing to hold the camera for a “selfie” is Fee. Witness-1 told JTTF that Fee lives in Freeport, New York.

 Your affiant also sent Witness-1 the driver’s license photograph depicted above. Witness1 confirmed that the individual in the photograph is the same Fee who was previously known to Witness-1 due to Fee’s relationship with Witness-1’s sister, i.e., the individual depicted in the “selfie” within the U.S. Capitol above. Witness-1 further stated that on or about January 6, 2021, Fee sent Witness-1 a video from inside the U.S. Capitol, which Witness-1 also deleted but then was able to recover and provide to DSS. Your affiant have reviewed that video and, based on the nature of the video and the other evidence described herein, your affiant believes that Fee took the video. The video shows numerous persons inside the Rotunda of the U.S. Capitol who do not appear to have authorization to be present. In the video, members of the crowd are heard yelling the word “tyranny” and the name “Pelosi,” which your affiant understands to be a reference to the Speaker of the House of Representatives Nancy Pelosi. Witness-1 stated that after Fee sent the video, Fee texted Witness-1, in sum and substance, that he was 'at the tip of the spear.'" As to Leffingwell, Inner City Press covered the case.   U.S. District Court for the District of Columbia Magistrate Judge G. Michael Harvey held the detention, or really non-detention, proceeding. Inner City Press live tweeted it here:  (then, song here)

Now in Federal Court in DC, hearing of detained  Mark Jefferson LEFFINGWELL who "attempted to push past me and other officers. When he was deterred from advancing further into the building, LEFFINGWELL punched me repeatedly with a closed fist."

Assistant US Attorney is *not* asking for detention . He'll be allowed to travel back home to Seattle.

 AUSA: We'll be requesting strict conditions... A stay-away from DC... A curfew.  Judge: You say he works. What is it? Lawyer: A packaging plant called Panacea in Everett, Washington. 30 to 40 hours a week.

 From the complaint: "I was struck in the helmet that I was wearing and in the chest. Working with other officers, I was able to gain control over LEFFINGWELL, who attempted to struggle while being detained. I transported LEFFINGWELL to US Capitol Police HQ."

Judge Harvey: Believe it or not, I have a lot of these case. Pre-Trial should find out about GPS in the Districts where these folks come from. I released someone else yesterday. Defense: GPS is not necessary. He has 2 children.

Defense: He wants to go to church on the weekend. No need to be on a GPS. We'll take a stay away. He's never been to DC before.

Mrs. Leffingwell: I'm an insurance agent. We have a son, Noah, and Nicholas. Judge: I am going to release Mr. Leffingwell.

Judge: You can turn in your guns to a police station. You must call pre-trial once a week and keep working [at the packaging plant.] Stay away from DC except for court. Our proceedings will be remote, you probably won't have to come.

 Judge Harvey: I don't see the point of putting him on a curfew if we're not going to do GPS. Defense: He needs his ID to fly back to Seattle.

AUSA: We have nothing.

 Defense: He passed his phone to one of his friends. I think they have his license.

AUSA: A third party? I can look for it. Which agency.

Defense: He was brought to 1-D-1, next to the baseball field, then the cell block.

Judge Harvey: I am going to release Mr Leffingwell. He must stay away from Washington DC. [That seems to be the main focus]

Judge Harvey: You'll have to Zoom in to the preliminary hearing... We've got the phone number, no worries, Mr. Leffingwell.
