After Mistrial for Brothers Taking $25 Million from Ethereum Sandwich Bots Pages Not Date

SDNY COURTHOUSE, Nov 13  – James Peraire-Bueno was indicted for "conspiracy to commit wire fraud, wire fraud, and conspiracy to commit money laundering.  The charges in the Indictment arise from an alleged novel scheme by the defendants to exploit the very integrity of the Ethereum blockchain to fraudulently obtain approximately $25 million worth of cryptocurrency within approximately 12 seconds."

On November 7 it went to 7 pm when the jury sent out a note they were suffering and making no progress. Judge Clarke declared a mistrial. On November 10 the US Attorney's Office wrote in asking for a retrial as early as February 2026 - the defense said picking a trial date now is not necessary, but if it is it should be late April 2026, letter on Patreon here

On November 13 Judge Clarke set page limits but not a date for argument or a new trial: "Application GRANTED in part, DENIED in part. The Court orders deadlines for the parties' proposed Rule 29 briefing as set forth above. Word limits shall be as follows: Defendants' motion and the Government's opposition may not exceed 17,500 words each, and Defendants' reply may not exceed 8,750 words. The parties may request additional length for their papers by filing a letter with the Court at least 48 hours prior to the deadline. The Court will follow up at a later date to schedule oral argument on the Rule 29 motion and a new trial date. SO ORDERED. (Signed by Judge Jessica G. L. Clarke on 1/13/2025)."
