Oct 22 – James Peraire-Bueno
was indicted for "conspiracy
to commit wire fraud, wire
fraud, and conspiracy to
commit money laundering.
The charges in the Indictment
arise from an alleged novel
scheme by the defendants to
exploit the very integrity of
the Ethereum blockchain to
fraudulently obtain
approximately $25 million
worth of cryptocurrency within
approximately 12
seconds."

Late on October
22, the US Attorney's Office
filed including that "the
defendants’ contention that
the Court must add
instructional language
requiring the jury to
unanimously agree on at least
one of the alleged
misrepresentations is squarely
foreclosed by governing law.
As noted above, the false or
fraudulent statement,
representation, pretense, or
act “is properly classified as
a means, rather than as an
element, of wire fraud.” ...
The jury need not be unanimous
as to the means of the fraud,
so long as it unanimously
finds that the Government has
proven the existence of the
