Settled & Tried Misusing DMCA to
Censor

2023 and Dec 15, 2025 – Keith
Fishberg sued State Farm for
not paying on an insurance
policy for water damage to his
apartment on East 15th Street
in Manhattan.
Then his lawyer
wanted out.
On April 5,
2021 U.S. District Court for
the Southern District of New
York Judge Lewis J. Liman held
a proceeding. Inner City Press
covered it.
Fishberg's
counsel said there are
irreconcilable difference
regarding the strategy for
pursuing the action.
Judge Liman
granted the motion to
withdrawn, and a 60 day stay.
Subsequently,
without any of the terms being
entered into the docket, the
case was settled and
dismissed. Then, no less than
four times, Fishman wrote to
Inner City Press claiming the
above factual report of the
proceeding and case defamed
him. No, reporting on courts
is not defamatory.
On December 15,
2025, researching a misuse of
DMCA by Louis Charboneau then
of Reuters, now of Human
Rights Watch getting removed
from Search his email to UN
Spokesman Stephane Dujarric
urging ouster from the UN of
Inner City Press, we came upon
this
in the Lumen database:

I have asked Inner City Press
to remove their one-sided and
incomplete article, which
publishes a preliminary court
action. Ultimately,
Defendant agreed that I
(Plaintiff) was in the right
and settled the
case. As a
result, of this publication I
have been defamed and suffered
material monetary damages...

There is
no right to removal of
accurate articles about court
proceedings. Why did Google
remove Charboneau's bogus complaint asserting
copyright for an embarrassing
email?
