COURTHOUSE,
Oct 21 – Jeffrey
Epstein, or his estates, have
been sued by Jane Doe 4 in the
U.S. District Court for the
Southern District of New York.
On October 21 Judge John G.
Koeltl held arguments toward a
motion to dismiss. Inner City
Press live tweeted it, thread
Plaintiff's
lawyer: Jane Doe 4 was
sexually assaulted by Jeffrey
Epstein, it was her first
sexual experience, she comes
from a country where it is
hard to pursue these things -
so she has met the burden, to
survive a motion to dismiss
Defense lawyer
Ruzumna of Patterson Belknap:
We - Judge: I was asked the
plaintiff about the other
case. Plaintiff's lawyer: It
was granted in part and denied
in part. Ruzumna: We got
summary judgment from Judge
Subramanian [of Diddy case
]
Judge Koeltl:
Didn't Judge Subramanian deny
your motion to dismiss?
Defense: But here, the
complaint is just general
about all Epstein alleged
victims. Here only Page
10 Judge: So the
plaintiff will NOT be asking
to file an amended complaint?
Plaintiff's counsel: We will
not, as long as they don't
raise anything new.
Judge: I'm
surprised, but it's
plaintiff's choice. Defendant:
We also want more info under
Rule 12(e)
Defense: This case was filed
on September 11 - and the date
on which this victim was
allegedly sexually assaulted
in Paris is artfully not
listed. So it should not
survive under statute of
limitations. Eliminate it now.
Dismiss it now
Plaintiff's
lawyer: We have alleged
sexually trafficking within
ten years, so that's it. 12(e)
motions are disfavored. Judge:
Why don't you give them the
date in 2015? Plaintiff's
lawyer: He harbored her.
Jeffrey Epstein had a history-
Judge: Stop.
Judge: What date
in complaint? Plaintiff's
lawyer: Paragraph 53. Defense:
That only says, "in 2015,
Epstein sexually assaulted Doe
while she was in Paris."
Plaintiff's lawyer: I did
misspeak. I do believe we
allege they are
timely...
Judge: Why won't
you say when? Plaintiff's
lawyer: The statute includes
the harboring. If you want me
to add in more detail, I can
Judge: If it moots the motion,
of course.
