After Luigi Mangione Hearing on Statute Divisibility Judge Wants Hearing on Altoona PD

SDNY COURTHOUSE, Jan 12 – Luigi Mangione was presented in Federal court on December 19 on four charges, one of them death penalty eligible, for the killing of UnitedHealth CEO Brian Thompson. Inner City Press was there, covering the case toward a book.

On April 1 DOJ announced it will seek the death penalty against Mangione.

On January 9 SDNY Judge Garnett held oral argument, mostly on the divisibility of the statute. At the end two trial dates were discussed: September 2026 if death penalty is taken off the table (by Judge's ruling), or January 2027 if it remains. Inner City Press live tweeted

On January 12 Judge Garnett said an Altoona PD witness and hearing will be necessary: "the Court hereby ORDERS the Government to produce for a hearing an officer of the Altoona Police Department with sufficient authority and experience to testify about the established or standardized procedures in use by the Department in December 2024 for securing, safeguarding, and, if applicable, inventorying the personal property of a person arrested in a public place. Because the inquiry will be focused on Department procedures, the witness need not have had any personal involvement in the Defendant's arrest. Given the very limited subject matter, the Court expects the hearing to be brief.... (Signed by Judge Margaret M. Garnett on 01/12/2026)."
