Man from Rikers Island Class Action Challenges Predicate Felon Sentence Successfully For Now

100 CENTRE STREET, Oct 16 – A man who was part of a Federal class action against solitary confinement on Rikers Island was brought into NYS Supreme Criminal Court last week, before Justice Ann Scherzer. Inner City Press was there, fresh in from SDNY where the class action was settled.

   This time the defendant was up for a resentencing hearing, having challenged his previous sentencing as a predicate felon successfully, at least technically. 

   Previously he took his case to trial, was convicted and sentenced to seven years. Justice Scherzer presaged that it may not go better this time, even as he challenges his predicate felon status.
