in Manhattan Court

CENTRE STREET,
Nov 6 – A man arrested as part
of a trio charged with an East
Harlem shooting on January 30,
2023 is on trial before
Justice Ann Scherzer in 100
Centre Street.
On November
6 the arresting officer was on
the stand.
In fact, he
only arrested two of the trio.
There was one grand jury
proceeding in February 2023 -
this defendant was taken up by
a second grand jury in October
2024.
"Have you
testified before?" the defense
lawyer asked him. "Did you put
your hand on the Bible and
--"
"We don't
have Bibles in this
courtroom," Justice Scherzer
cut in acidly, noting the
separation of church and
state.
"Did you
swear or affirm?" the defense
lawyer asked again. He had.
There followed some questions
about unspecified errors in
the officer's reporting,
leading to a whispered sidebar
and then a bathroom
break. The trial
continues.
