SDNY COURTHOUSE,
Nov 6 – For the murder of
Johnny Gaston on December 15,
2022, Gibran Guerrero and
Yorvin Gomez were presented
and detained on August 21 in
U.S. District Court for the
Southern District of New York
Magistrates Court, which Inner
City Press closely covers.
The prosecutors
says they "lured two victims
to a location in the Bronx and
robbed them. During the
robbery, one of the victims,
Johnny Gaston, was shot and
killed. The other victim
was shot but survived."
The Augst 9
indictment unsealed on August
21 charges murder in aid of
racketeering. It was wheeled
out to District Judge Lorna G.
Schofield.
On October 21,
counsel to Guerrero wrote in
about "a change of plea
hearing in the near future."
And Guerrero came to the SDNY
Magistrates Court on October
29. But the plea did not go
forward. He may re-appear on
Firday, November 1...
On November 1 he
decided to change lawyers, and
got the day's CJA on duty.
Later the AUSA wrote in to
delay the trial.
On November 6
Judge Schofield endorsed that
the parties by November 21
should file a joint letter
about moving the trial to
February 2025 or later April
2025.
The case is
US v. Guerrero, et al.,
23-cr-411 (Schofield)
