SDNY COURTHOUSE,
Oct 28 – Fuad
Tareb pleaded
guilty on
August 17,
2023 to
defrauding the
US Department
of
Agriculture,
by exchanging
cash and
cigarettes
from SNAP food
stamp
benefits.
It was not the
first time he
did it. The
prosecutors
say he
previously got
thrown out of
the SNAP
program, but
then reapplied
using another
person's name.
The person was
told that a
"non-Arabic"
name was
needed.
Various
storefronts in
3201 White
Plains Road in
The Bronx were
used. A
cashier, Don
Commuck, was
enlisted.
Commuck also
pleaded guilty
on August 17
before U.S.
District Court
for the
Southern
District of
New York Judge
Paul G.
Gardephe.
Inner City
Press was
there, the
only media in
the courtroom.
Both were set
to be
sentenced on
December 19,
within one
hour.
On
November 27,
Commuck's
Federal
Defender wrote
it requesting
three years
supervised
release with
six months'
home
detention.
On
December 6,
the US
Attorney's
Office wrote
in and asked
for a sentence
within the 33
to 41 month
guidelines.
On
December 19,
Judge Gardephe
pushed back
Commuck's
sentencing to
June 20, 2024
at 10 am.
On
June 13,
Commuck's
Federal
Defender wrote
in that "he
has stopped
smoking
marijuana" -
and asked for
a
non-incarceratory
sentence on
June 20.
On
June 20,
Commuck was
sentenced to
time served
and three
years
supervised
release.
On
February 13,
2024 for Fuad
Tareb, defense
counsel wrote
in requesting
a time served
sentence.
On
October 15,
the US
Attorney's
Office wrote
in asking for
"a sentence
below 30
months." 29?
On
October 25, he
was sentenced
to 18 months.
