Men Charged With Murder and Shooting
Jailed Now Lead Defendant for Asks 20
Years

SDNY MAG COURT
EXCLUSIVE, July 8 - In
the U.S. District Court for
the Southern District of New
York on August 19, a bail
review was held by Magistrate
Judge Barbara C. Moses on a
defendant, Boss Terrell,
charged with playing a role in
a murder and being caught on
video shooting a gun a month
later in The Bronx.
Inner City Press was there,
the only media in the Mag
Court.
Terrell
had two lawyers - it being a
death penalty eligible case,
he has Learned Counsel - and
his parents in the gallery.
His father was wearing a New
York Giants jersey with
[Lawrence] Taylor written on
it. Defense counsel said he
worked for the Housing
Authority until a co-worked
dropped a refrigerator back on
him.
Judge Moses expressed
sympathy for the parents, but
declined to grant bail, on
both the danger to the
community and the risk of
flight prongs. Time was
allowed for the defendant to
tell his year-old son to
remember him. Then he was
gone.
Afterward
Inner City Press gleaned that
while the change of being
released had been very low, at
least this way the defense got
some discovery, for example
learning about the video of
the July 2020 incident.
Jump cut to
December 14, when
co-defendants were presented
in the Magistrates Court,
before Mag Judge James L.
Cott. For detention, a
pawnshop robbery in Queens,
violence including murder and
the use of social media and
hip hop music to brag about it
were cited. It was too much:
detention was ordered, at
least pending the next
proceeding before Judge
Furman.
The next
proceeding took place on
December 20, in larger
courtroom 23B. Inner City
Press was there, as were a
number of family members and
supporters. Judge Furman
inquired into three defendants
missing - two in custody, one
not in custody - and into the
need for another Learned
Counsel on this murder case.

for March 28 at 2:30 pm. More

On January 12,
another co-defendant was
presented and detained, on
consent: "Minute Entry for
proceedings held before
Magistrate Judge Robert W.
Lehrburger: Initial Appearance
on disposition sheet as to
Isaiah Thomas held on
1/12/2023 BAIL DISPOSITION:
Detention on consent without
prejudice. Defendant arraigned
and pleads not guilty."
On March 28,
Judge Jesse Furman held a
status conference and ordered:
"as to Boss Terrell, Yaurel
Centeno, Lydell Seymore,
Darrell Spencer, Isaiah
Thomas, Tyshawn Brogdon,
Rasheed Chapman, Mamadou
Diallo, Antwan Mosley, and
Noel Carr held on 3/28/2023.
Defendants all present...
Motions due by 9/8/2023.
Opposition due by 9/29/2023.
Replies due by 10/6/2023. A
joint scheduling order is due
by 9/8/2023. Trial is
scheduled for 3/11/2024 and is
estimated to last about 3
weeks. Time is excluded in the
interests of justice from
3/28/2023 until 3/11/2024."
On January 11,
2024, Thomas pleaded guilty:
Minute Entry for proceedings
held before Judge Jesse M.
Furman: Change of Plea Hearing
as to Isaiah Thomas held on
1/11/2024. Defendant withdraws
previously entered not guilty
plea and enters a plea of
GUILTY to Count 8 of the S1
Indictment and Counts 9 and 13
of the lesser included charge
of the S1 Indictment. PSR
ordered. Sentencing is
scheduled for 4/17/2024 at
3:00 PM
On January 18,
Chapman pled in Mag court:
"proceedings held before
Magistrate Judge Katharine H.
Parker: Change of Plea Hearing
as to Rasheed Chapman held on
1/18/2024. Defendant
enters a plea of Guilty to
Count # 10 and 11. Court
reporter present. Detention
continued. PSI ordered.
Sentencing date: May 7th at
3pm."
The lead
defendant in the case, Boss
Terrell, had a change of plea
scheduled in the Magistrates
Court, with one of his two
lawyers (the one is on trial
in the District of
Connecticut). It did not
happened in the time and place
noticed - but on January 26:
"Change of Plea Hearing as to
Boss Terrell held on
1/26/2024. Plea entered by
Boss Terrell (1) Guilty as to
Count 2s,5s. Defendant enters
a guilty plea as to Counts 2
and 5. Sentencing date set for
5/15/2024 at 3PM."
On January 31,
co-defendant Jacob Baker came
to plead guilty, to counts 1
and 11. The prosecutor tried
to get him to allocute to
helping another shoot, but he
pushed back. So direct
reference to any other was
dropped. The prosecutor said
they had social media, and the
only other civilian in the
gallery, apparently his
mother, shook her head. Jacob
Baker is 20 years old. His
sentencing is set for May 16
at 3 pm.
On February 5,
also in the Mag Court where
Inner City Press was, guilty
plea to SUPERSEDING
INFORMATION (Felony) filed as
to Darrell Spencer (4)
count(s) 1s, 2s, 3s, 4s.
On April 30,
co-defendant Antwan Mosley
through counsel asked for
significantly less than the
108 months recommended by
Probation when he is sentenced
on May 14, citing the death of
his mother and concluding, his
"story is still being
written."
On May 7, the US
asked for 181 months on
Mosley.
On May 14, Mosley
got 10 years: "JUDGMENT IN A
CRIMINAL CASE as to Antwan
Mosley (10). THE DEFENDANT:
pleaded guilty to counts 8 and
9 of the S1 Indictment. All
open Counts are dismissed on
the motion of the United
States IMPRISONMENT: 60 months
on Count 8 and 60 months on
Count 9, to be served
consecutive to the sentence
imposed on Count 8 for a total
of 120 months."
Also on May 14,
on co-defendant Isaiah Thomas,
the US Attorney's Office asked
for 330 months.
On May 20,
Mamadou Diallo in the case
asked for a below guidelines
sentence, citing his parents'
immigration from West Africa
and quoting Judge Furman's
Chavez decision.
On May 24, the US
Attorney's Office wrote in to
ask for a 10 year sentence on
May 30.
On May 30, Diallo
got 7 years: "JUDGMENT In A
Criminal Case (S1
22-Cr-343-9). Date of
Imposition of Judgment:
5/30/2024. Defendant Mamadou
Diallo (9) pleaded guilty to
Count(s) 1 of the S1
Indictment. Count(s) All open
counts are dismissed on the
motion of the United States.
IMPRISONMENT: 84 months."
On July 8, the
lead defendant through counsel
asked for a sentence of 20
years; sentencing it set for
July 26 at 2:30 pm.
