US Detained in 26 Fed Filed Habeas
But US Says Already in NJ

COURTHOUSE,
Nov 19 – A man from China who
says he entered the US through
the border with Mexico,
fleeing religious persecution
in China, was detained by ICE
at his appointed in 26 Federal
Plaza on November 6.
Though a lower Broadway-based
lawyer he filed a habeas
petition on which a hearing
was set for November 20 before
U.S. District Court for the
Southern District of New York
Judge Margaret G. Garnett.
Inner City Press, which found
the petition, planned to
attend.
The US
Attorney's Office responded
that by the time the petition
was filed, the petitioner had
been moved to New
Jersey.
But counsel
responded that it was filed on
November 7, before the move to
New Jersey - and provided a
print out of paying the $5 fee
as evidence.
The case
is Xie v. Bondi, et al.,
1:25-cv-9318 (Garnett)
