SDNY
COURTHOUSE, Dec
13 – Mohsen Shojaeinia was
arrested in March 2023, for
importing meth and heroin into
the US from Turkey and the UK.
He was extradited in and was
appointed publicly-funded
counsel, then hired his own
lawyer.
On May 1,
2024 he was scheduled to plead
guilty before U.S. District
Court for the Southern
District of New York Judge
Paul G. Gardephe. Instead, the
retained lawyer was relieved,
and an appointment of counsel
scheduled in the SDNY
Magistrates Court. Inner City
Press was there.
SDNY
Magistrate Judge Barbara C.
Moses asked Shojaeinia if he
had been detained one year
already. Yes (vale), he said,
and one year before that
awaiting extradition.
Unfortunately. Even in leg
irons, he was surprisingly
chipper.
New counsel
was appointed for a May 22
rescheduled guilty plea.
Inner City Press
went on May 22. Shojaeinia
answered Judge
Gardephe in
English, but
still had the
Farsi
interpreter.
His plea deal
is for 135 to
168 months.
Sentencing is
set for
October 4 at 3
pm.
On
September 23,
his lawyer
wrote in and
asked for
60 months.
On September
30, the US
Attorney's
Office wrote
in asking for
135 months -
then on October
11 responded
to Judge
Gardephe's
order by
writing in,
with
redactions,
that surface
to air
missiles, SAMs,
were present
during, or in
connection
with,
defendant's drug
trafficking,
triggering
a two point
enhancement.
On
November 11
after ruling
on the weapons
enhancement,
defense
counsel wrote in
asking to
delay the
November 12
sentencing, to
December 5 or
thereafter.
On
November 12
Judge Gardephe
moved it to
December 5 and
stated that
"no further requests
for adjournment
will be granted.
On
November 15
white shoe defense
counsel wrote
in asking
for.. another
adjournment.
On
December 13, he was
sentenced to
87 months in
prison.
The case is US v.
Shojaeinia, 22-cr-379
(Gardephe / Moses)
