Man Held by ICE on Feb 24 Set For Transfer Out of State Files SDNY Habeas Denying Gang

SDNY COURTHOUSE, Feb 24 –A man from El Salvador was held by ICE in 26 Federal Plaza as of 8:21 am on February 24.

He filed a habeas corpus petition in the US District Court for the Southern District of New York later on February 24, where Inner City Press found it. 

 The case was assigned to Judge Mary Kaye Vyskocil. The petition says he is "being processed for removal to an out of state ICA location, presumably Louisiana." It adds that his girlfriend and the mother of his child told police he'd said he was a member of a gang."

He denies being a member of a gang, "admitting only that he knew members of a gang and had given them a ride (under threats to his live) while still previously in El Salvador."

  On the previous working day in SDNY, February 20, when the US Attorney's Office wrote in, it was to say that venue is improper, that the petitioner was "booked out of 26 Federal Plaza at 12:25 pm on February 19, where was she was taken to Newark Liberty Airport and flown to Louisiana" - the Richwood Correctional Center in Monroe, Louisiania.

Flying out the same day avoids SDNY venue. Or will it? And here?
