Convicted Hezbollah Helper Saab Got 3 Guilties 3 Not 1 Empty & 12 Years Now 2 Cir Says Redo

By Matthew Russell Lee, Patreon Song

SDNY COURTHOUSE, Jan 14 – Alexei Saab, charged with providing aid to Hezbollah, had a proceeding before  U.S. District Court for the Southern District of New York Judge Gardephe on June 15, 2020. Inner City Press covered it, as it did another hearing on April 7, 2021, here and below.

On May 11 after days of deliberation the jury determined that Saab is not guilty on three of seven counts, guilty on three (false statements, conspiracy to commit marriage fraud and Receiving Military-Type Transing from a Foreign Terrorist Organization) and no decision on "Providing Material Support or Resources for an FTO." Verdict sheet here.

On May 23, 2023, Saab was sentenced to 12 years. Inner City Press was there, thread here

Jump cut to January 14, 2026 when the Second Circuit Court of Appeals ruled "because the district court plainly erred by applying the Terrorism Enhancement and the record does not clearly indicate the district court would apply the enhancement on the alternative basis proffered on appeal by the government, we vacate the sentence and remand for resentencing. Accordingly, we AFFIRM the convictions, VACATE the sentence and REMAND the case for resentencing consistent with this opinion. Judge Sullivan concurs in part and dissents in part in a separate opinion."

The case is US v. Saab, 19-cr-676 (Gardephe).
