Aug 20 – A man who
pled guilty to fraudulently
obtaining sophisticated
pharmaceuticals and reselling
them to "the community" is up
for sentencing on April 15.
His Federal Defender, citing
crystal meth and a disease
repeatedly redacted, is asking
for a 24 month sentencing,
below the 70 to 87 month
guideline.
The defense
memo describes a (very)
difficult childhood, a two
year period of sex work ending
in a redacted diagnosis, and a
previous conviction for
identity theft and health care
fraud.
It says
that the more than $2 million
loss amount was not to
patients or medical providers,
but rather insurance companies
and co-pay programs.
Then the US
Attorney's Office wrote in
asking for 52 months in
prison.
He got 36 months,
the last 10% of which are to
be served on home detention,
starting June 5.
On June 4 defense
counsel wrote it asking for an
extra month, citing a need to
relocate the family due to
retaliation threats. The same
day, Judge Vargas granted the
extension to July 5.
The other
defendant pled guilty and was
to be sentenced on June 5. But
it did not happen. Amid two
"sealed document placed in
vault" entries, on August 20
Judge Vargas ordered that he
get medical and psychiatric
evaluation and medication asap
in Westchester County Jail.
