Man Pled Guilty to Buying Guns in Tennessee to Sell Them in NY Now 2d Gets 10 Years

SDNY COURTHOUSE, Oct 10 – A man charged with buying guns in Tennessee and selling them in New York pled guilty on January 30 before U.S. District Court for the Southern District of New York Judge Valerie E. Caproni. Inner City Press was there, the only media in the courtroom.

  Judge Caproni asked if the defendant understood he was waiving the statute of limitations, then explained it. She asked if he understood he was waiving the right to appeal any sentence five years or below, as put in the plea agreement.

  Yes, was the answer.   Sentencing was set.

On February 20 as to co-defendant Diaz, facing trial April 7, the US Attorney's Office's office wrote in asking to adjourn deadlines given discussions of a pre-trial resolution.

On March 10, the US Attorney's Office wrote in seeking a change of plea date for Diaz; Judge Caproni set it for March 20 at 2:30 pm.

But on March 20, Judge Caproni set the trial date back to April 28, with filings due April 18. Unless...

On April 2, the US Attorney's Office wrote in asking the Court to schedule a change of plea hearing, suggesting April 4 at 2:30 pm.

And he did plead guilty, with sentencing set for July 16.

On July 2, for sentencing pushed to July 17, the Federal Defender in a redacted submission asked for time served for lead defendant Tyson.

On July 31 he got five years probation, the first six months subject to a curfew set by Probation.

On October 9 Diaz was sentenced to ten years.

 The case is USA v. Tyson, 1:24-cr-252 (Caproni)
