Jan 23 – A 25-year old man
from Ecuador who was detained
by ICE on January 15 while
waiting for his immigration
check-in on the 12th floor of
26 Federal Plaza was ordered
free on January 23 by U.S.
District Court for the
Southern District of New York
Judge Valerie E. Caproni.
Inner City Press was there,
the only media in the
courtroom.
Franklin Ivan
Pastuna Pastuna was not in
court - he is detained - but
Judge Caproni ordered him
released by 5 pm, less then
two hours after her ruling,
with a confirmatory letter due
on Saturday.
The
Assistant US Attorney arrived
with a PointPoint, seeking to
convince Judge Caproni to not
follow the lead of her
colleague Judge Lewis J. Liman
in Qasemi v. Francis. But
Judge Caproni called that
decision well-reasoned, and
followed it.
Further
briefing is due on whether the
Government could re-detain
Pastuna Pastuna, or invoke an
automatic stay. Inner City
