NYC Is Denied Injunction on Claw Back of FEMA Funds As No Irreparable Harm Found

SDNY COURTHOUSE, March 5 – New York City sued the Trump Administration for what it called the "money grab" of FEMA funds for the Roosevelt Hotel. On March 5 U.S. District Court for the Southern District of New York Judge Jennifer H. Rearden held order argument then denied the City's motion. Inner City Press live tweeted, from the thread

NYC's Rubin: We know it's extraordinary to ask to have the money returned at the beginning of the case. But these funds are under risk. There's a bill in Congress, we've cited that. One of the defendants has said this money has reduced the debt. 

Administration lawyer Emily Hall: There is no irreparable harm. It they win, the money will be returned.  

Judge Rearden: The Court will not purport to grant injunctive relief to preempt Congressional recission. The City cites Senate Bill S-771 referred on Feb 27 to the Homeland Security Committee. But the text is not available - so, it's speculative 

Judge Rearden: In sum, the City has identified no irreparable harm - so it is unnecessary to reach the other factors. For the foregoing reasonsNYC's motion for a Temporary Restraining Order is denied
