Dismissal Now Released in SDNY

COURTHOUSE,
Dec 3 – Deglis Salazar Ozuna
entered the US, ultimately
from Venezuela, on October 7.
2022. He was released on his
own recognizance until on
November 25, 2025 showing up
for a check-in with ICE in 26
Federal Plaza in lower
Manhattan he was detained.

He was
transferred to the Orange
County Jail. But his habeas
corpus petition was heard on
December 3 by U.S. District
Court for the Southern
District of New York Judge
Ronnie Abrams.
While it
had been claimed he has
"pending criminal charges,"
those charges (for burglary)
were dismissed and sealed.
Under NY CPL 160.60 they
"shall be deemed a nullity."
On December
3, Judge Abrams ordered him
released. Docketed: the Court
finds that the Government
violated Petitioner's right to
due process under the Fifth
Amendmetn, grants his write of
habeas corpus and orders him
immediately release from
custody."
