COURTHOUSE,
Nov 15 – A man who was set to
begin trial on July 22 on
charges of being a felon in
possession of ammunition -
based on a shooting from a car
registered to his mother -
appeared with little notice on
July 19 before U.S. District
Court for the Southern
District of New York Judge
Paul A. Engelmayer.
Inner City Press
was there, but not for
long.
Judge Engelmayer
asked the Press - and
prosecutors - to step out so
he could hear why the
defendant wanted to fire his
CJA counsel on the eve of
trial, with the statement that
he and his mother were making
other arrangements.
When the
shut-out from the courtroom
ended, it was announced that
he would be pleading guilty,
after a forty-five minute
break.
That turned into
an hour, but he did plead
guilty, to a Pimintel letter
(not plea agreement) and
sentencing was set for
November 13.
On October 30
Morales' lawyer wrote in
asking for two years, not the
46 months guideline.
On November 4 the
US Attorney's Office wrote in
asking for more: 84 months.
On November 15,
Judge Engelmayer sentenced him
to 66 months, recommending
Fort Dix or FCI Danbury. On
November 16, defense counsel
wrote in to correct the
judgment.
The case is USA
v. Morales, 1:24-cr-84
(Engelmayer)
